Consumer Health Data

Global Privacy Control (GPC)
We recognize and honor the Global Privacy Control (GPC) signal, and equivalent browser-based opt-out preference signals, as a valid request to opt out of the sale or sharing of personal information under the CCPA and other applicable state laws. When we detect a GPC signal from your browser, we process it as an opt-out for that browser or device and will display confirmation that the signal was received, as required by California regulations effective January 1, 2026.

We retain personal information only for as long as reasonably necessary to provide the Services, comply with legal, tax, and accounting obligations, resolve disputes, and enforce our agreements

We follow industry-standard safeguards to protect personal information from loss, misuse, unauthorized access, disclosure, alteration, or destruction. Payment card data is encrypted using SSL/TLS and processed by Shopify Payments, which is PCI-DSS Level 1 compliant. No method of transmission or storage is 100% secure, and we cannot guarantee absolute security.
9. Children’s Privacy
Our Services are not directed to children under 13, and we do not knowingly collect personal information from children under 13 without verifiable parental consent, consistent with the Children’s Online Privacy Protection Act (COPPA). If you are a parent or guardian and believe your child has provided us with personal information without your consent, contact us at the address in Section 16 and we will delete it.
10. Mobile / SMS Messaging Program
Theralogix mobile message service (the “Service”) is operated by Theralogix. Your use of the Service constitutes agreement to these terms (“Mobile Terms”). We may modify or cancel the Service, or these Mobile Terms, at any time, to the extent permitted by applicable law.
By consenting to our SMS/text messaging service, you agree to receive recurring SMS/text messages from or on behalf of Theralogix, sent to the mobile number you provided, potentially using automated dialing technology, even if that number is on a state or federal Do Not Call list. Messages may include service-related updates (order and account alerts) and, where you have opted in, promotional messages (offers, cart reminders).
Signing up is not required to make a purchase and is not a condition of any purchase. We do not charge for the Service; message and data rates from your wireless carrier may apply, and message frequency varies.

You will receive a one-time confirmation; no further messages will be sent unless you re-initiate contact. For help, text HELP to +18445082157 or email support@theralogix.com. If you are enrolled in more than one Theralogix messaging program, you must opt out of each separately unless applicable law requires otherwise.
We do not share your SMS opt-in status with third parties except vendors who help us deliver the messaging service itself (e.g., platform providers, telecom carriers).

We will verify your identity by matching the information you provide against records we hold. If we deny your request, you may appeal by replying to our denial notice; if your appeal is denied, [state] residents may then contact their state Attorney General.
California “Shine the Light”
California residents may request, once per calendar year and free of charge, information about any personal information we disclosed to third parties for their own direct marketing purposes in the prior calendar year, by contacting us at the details in Section 16.
13. Consumer Health Data
Washington, Nevada, and Connecticut have enacted laws that specifically protect “consumer health data” — information that identifies a consumer’s past, present, or future physical or mental health status, including reproductive or sexual health information, and inferences derived from otherwise non-health data (such as purchases of fertility, prenatal, or similar products).
Because Theralogix sells products related to fertility and reproductive health (including Ovasitol), information such as your purchase of these products, or your activity on related pages, may qualify as consumer health data under these laws, regardless of where you are located when you interact with our Services.

14. Third-Party Services, Shopify, Payments & Affiliates
Shopify
Shopify, Inc. provides the e-commerce platform we use to sell our products. Your data is stored in Shopify’s databases behind a firewall on secure servers.
Payments
Payments are processed through Shopify Payments, which is PCI-DSS Level 1 compliant. Transaction data is encrypted and retained only as long as necessary to complete your order; for auto-refill subscriptions, payment data needed for future authorization is securely stored by Shopify Payments in compliance with PCI-DSS.
Other Third-Party Services
Other service providers, including payment gateways, generally collect, use, and disclose information only to the extent necessary to perform services for us. Some maintain their own privacy policies for information they need for your purchase transactions; we encourage you to review those policies. Once you leave our site or are redirected to a third-party site or app, this Privacy Policy no longer applies.
Affiliates
If you arrive at our site through an affiliate, both Theralogix and the affiliate consider you a customer, and this Privacy Policy still applies. We may share your data with the specific affiliate that referred you, but only where you are a shared customer.

15. Changes to This Privacy Policy
We may update this Privacy Policy from time to time. The “Last Updated” date at the top reflects the most recent revision. Where we make a material change to how we use previously collected personal information, we will provide notice (such as an email or a prominent notice on our website) before the change takes effect, as required by applicable law. If our business is acquired or merged, your information may be transferred to the new owner so that we can continue providing our products and services to you.
