Theralogix (“Theralogix,” “we,” “us,” or “our”) respects your privacy. This Privacy Policy explains how we collect, use, disclose, and protect personal information when you visit theralogix.com, purchase our products, sign up for our mobile messaging program, or otherwise interact with us (collectively, the “Services”), and describes the rights available to you, including under the California Consumer Privacy Act (CCPA), other U.S. state privacy laws, the EU/UK General Data Protection Regulation (GDPR), and state consumer health data laws such as Washington’s My Health My Data Act.

By using our Services, you agree to the practices described in this Privacy Policy.

2. Information We Collect

Consumer Health Data 

Some of our products (for example, Ovasitol) relate to fertility and reproductive health. Because of this, your purchase history, activity on related product pages, or communications with us about these products may qualify as “consumer health data” under certain state laws. Section 13 (“Consumer Health Data”) explains how we handle this category specifically, in addition to the general protections in this policy.

How Do You Get My Consent? 

When you provide personal information to complete a transaction — place an order, verify a payment method, arrange delivery, or process a return — we treat that as your consent to our collecting and using that information for the transaction. For any secondary use, we will ask for your express consent (an opt-in or clear disclosure) and give you a way to opt out at any time.

How Do I Withdraw My Consent?

You may withdraw consent for us to contact you, or for our continued collection, use, or disclosure of your information, at any time by contacting us at webmaster@theralogix.com or by mail at the address in Section 16. 5. How We Share Your Information

We do not sell personal information for money. We share personal information with:

Certain state privacy laws define “sale” and “share” broadly enough to include some cookie-based advertising, even without an exchange of money. See Section 6 for how we address that and how to opt out.

6. Cookies, Analytics & Your Advertising

Choices Cookies support core shopping functions (Shopify session and cart storage, for up to two weeks) as well as analytics and, where used, interest-based advertising.

Global Privacy Control (GPC) 

We recognize and honor the Global Privacy Control (GPC) signal, and equivalent browser-based opt-out preference signals, as a valid request to opt out of the sale or sharing of personal information under the CCPA and other applicable state laws. When we detect a GPC signal from your browser, we process it as an opt-out for that browser or device and will display confirmation that the signal was received, as required by California regulations effective January 1, 2026.

7. Data Retention

We retain personal information only for as long as reasonably necessary to provide the Services, comply with legal, tax, and accounting obligations, resolve disputes, and enforce our agreements

8. Security

We follow industry-standard safeguards to protect personal information from loss, misuse, unauthorized access, disclosure, alteration, or destruction. Payment card data is encrypted using SSL/TLS and processed by Shopify Payments, which is PCI-DSS Level 1 compliant. No method of transmission or storage is 100% secure, and we cannot guarantee absolute security.

9. Children’s Privacy

Our Services are not directed to children under 13, and we do not knowingly collect personal information from children under 13 without verifiable parental consent, consistent with the Children’s Online Privacy Protection Act (COPPA). If you are a parent or guardian and believe your child has provided us with personal information without your consent, contact us at the address in Section 16 and we will delete it.

10. Mobile / SMS Messaging Program

Theralogix mobile message service (the “Service”) is operated by Theralogix. Your use of the Service constitutes agreement to these terms (“Mobile Terms”). We may modify or cancel the Service, or these Mobile Terms, at any time, to the extent permitted by applicable law.

By consenting to our SMS/text messaging service, you agree to receive recurring SMS/text messages from or on behalf of Theralogix, sent to the mobile number you provided, potentially using automated dialing technology, even if that number is on a state or federal Do Not Call list. Messages may include service-related updates (order and account alerts) and, where you have opted in, promotional messages (offers, cart reminders).

Signing up is not required to make a purchase and is not a condition of any purchase. We do not charge for the Service; message and data rates from your wireless carrier may apply, and message frequency varies.

You may opt out at any time by texting STOP to +18445082157, or in reply to any message from us. You will receive a one-time confirmation; no further messages will be sent unless you re-initiate contact. For help, text HELP to +18445082157 or email support@theralogix.com. If you are enrolled in more than one Theralogix messaging program, you must opt out of each separately unless applicable law requires otherwise.

We do not share your SMS opt-in status with third parties except vendors who help us deliver the messaging service itself (e.g., platform providers, telecom carriers).

11. International Users — EU/UK GDPR

If you are located in the European Economic Area, United Kingdom, or Switzerland, this section applies in addition to the rest of this Privacy Policy.

12. Your U.S. State Privacy Rights 

This section applies to residents of California, Virginia, Colorado, Connecticut, Utah, Texas, Oregon, Montana, Delaware, Iowa, Nebraska, New Hampshire, New Jersey, Minnesota, Maryland, and other states with comprehensive consumer privacy laws in effect, to the extent each law applies to Theralogix.

Categories of Personal Information

We Collect Identifiers (name, address, email, phone); commercial information (purchase history); internet or network activity; approximate geolocation; audio/customer-service records; and inferences drawn from the above.

We Do Not Sell Personal Information

Theralogix does not sell personal information for monetary consideration. As noted in Section 6, certain cookiebased advertising activity may be treated as a “share” under some state laws even without a sale, and you can opt out as described there.

Your Rights

We will verify your identity by matching the information you provide against records we hold. If we deny your request, you may appeal by replying to our denial notice; if your appeal is denied, [state] residents may then contact their state Attorney General.

California “Shine the Light”

California residents may request, once per calendar year and free of charge, information about any personal information we disclosed to third parties for their own direct marketing purposes in the prior calendar year, by contacting us at the details in Section 16.

13. Consumer Health Data

Washington, Nevada, and Connecticut have enacted laws that specifically protect “consumer health data” — information that identifies a consumer’s past, present, or future physical or mental health status, including reproductive or sexual health information, and inferences derived from otherwise non-health data (such as purchases of fertility, prenatal, or similar products).

Because Theralogix sells products related to fertility and reproductive health (including Ovasitol), information such as your purchase of these products, or your activity on related pages, may qualify as consumer health data under these laws, regardless of where you are located when you interact with our Services.

Our Commitments

      • We do not sell consumer health data without your valid authorization, obtained separately from any other consent, specifying what will be sold, to whom, and how long the authorization remains valid
      • We do not use geofencing technology around in-person healthcare facilities to identify, track, collect data from, or send communications to consumers seeking health care services

14. Third-Party Services, Shopify, Payments & Affiliates

Shopify

Shopify, Inc. provides the e-commerce platform we use to sell our products. Your data is stored in Shopify’s databases behind a firewall on secure servers.

Payments

Payments are processed through Shopify Payments, which is PCI-DSS Level 1 compliant. Transaction data is encrypted and retained only as long as necessary to complete your order; for auto-refill subscriptions, payment data needed for future authorization is securely stored by Shopify Payments in compliance with PCI-DSS.

Other Third-Party Services

Other service providers, including payment gateways, generally collect, use, and disclose information only to the extent necessary to perform services for us. Some maintain their own privacy policies for information they need for your purchase transactions; we encourage you to review those policies. Once you leave our site or are redirected to a third-party site or app, this Privacy Policy no longer applies.

Affiliates

If you arrive at our site through an affiliate, both Theralogix and the affiliate consider you a customer, and this Privacy Policy still applies. We may share your data with the specific affiliate that referred you, but only where you are a shared customer.

Links on our site may take you to third-party sites. We are not responsible for their privacy practices and encourage you to review their policies.

15. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. The “Last Updated” date at the top reflects the most recent revision. Where we make a material change to how we use previously collected personal information, we will provide notice (such as an email or a prominent notice on our website) before the change takes effect, as required by applicable law. If our business is acquired or merged, your information may be transferred to the new owner so that we can continue providing our products and services to you.
